Indefinite prison term for hyperaggravated murder of a minor child
In a recent ruling, the Supreme Court (TS) has upheld the indefinite prison term for a man for the murder of his minor child in Valencia. The facts are particularly harsh, the father killed the child in a very violent way, acting with cruelty, with the intention of causing the maximum possible harm to his ex-partner, the child's mother, whom he had subjected to abuse, threats, and harassment for years. The previous relationship was characterized by male dominance and gender violence, and furthermore, the convicted individual had previously violated judicial orders of restraining and no-contact with the mother.
Although the defendant's defense tried to argue for mitigating circumstances, such as acknowledging the facts, offering to make reparations, and a possible temporary mental disorder, the court did not accept any of these arguments. The confession came when there was no longer any doubt about the facts, the reparation did not materialize and no mental disorder relevant at the time of the offense.
Ultimately, the Supreme Court considers that both cruelty and malice in the death of the minor, as well as the aggravating factors of kinship and discrimination based on gender, which gives rise to the maximum penalty provided, indefinite prison term. Additionally, the convicted individual was found guilty of other crimes such as assault, threats, and ongoing abuse.
